Hobie Polarized Friendly Limited Lifetime Warranty (For Purchasers in Australia).
Hobie Polarized sunglasses are warranted to the original purchaser against manufacturer defects in materials and workmanship for the LIFETIME of the sunglass.
This warranty does NOT cover:
This warranty does not apply to sunglasses;
- That have been subject to improper or unreasonable use
- Accidental breakage
- Scratched lenses
- Products that were not compliant with the care and cleaning instructions.
Hobie Polarized sunglasses will replace, at our discretion, any pair of Hobie Polarized Sunglasses manufactured and distributed by Eyeking, LLC, under license to Hobie Asia Pacific, that falls within the guidelines of this warranty.
TO OBTAIN WARRANTY SERVICE:
Within 30 days of discovering a defect, take your product, along with the proof of purchase (sales receipt) to the Authorized Hobie Polarized Dealer from whom you purchased your products from unless you have moved or are traveling. In that case, take it to the nearest Authorized Hobie Polarized Dealer for warranty support.
If your warranty claim is deemed to be valid, we will replace or repair the product. Any expense incurred in returning product for warranty assessment will be done so at the expense of the purchaser. If the returned product is deemed to be a valid warranty claim the Hobie Polarized will incur the cost of any further freight charges. If the warranty is deemed to be invalid, we will contact you to see if you want us to conduct repairs at your cost and, in any event, you will be charge the outbound freight based on Hobie Polarized’s standard shipping rates.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonable foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits given to you under our warranty are in addition to other right and remedies you have under the Australian Consumer Law and other laws.
IMPLIED WARRANTIES
Any implied warranties, including implied warranty of merchantability and fitness for a particular purpose, shall be no longer than the duration of this expressed warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you.
Hobie Cat Company makes no expressed warranties in addition to this limited warranty. Hobie Dealers have no authority to make warranties on behalf of Hobie Cat Company in addition to, or inconsistent with, those stated herein.
To the extent any provision of this warranty is prohibited by Federal, State or Municipal law and cannot be preempted, it shall not be applicable. This warranty gives you specific legal rights.
